Section 1557 News!
Oct 25, 2016Section 1557 of the Affordable Care Act (ACA) prohibits discrimination on the basis of race, color, national origin, sex, age or disability in any health program or activity which receives funding from the U.S. Department of Health & Human Services (HHS).
On May 13, 2016, the HHS Office for Civil Rights (OCR) issued the final rule implementing Section 1557.
Covered dental practices must be in complete compliance as of October 17, 2016. While the rule has good intent, many of the requirements have placed a substantial burden on dental practices to comply with the policies and procedures. One such requirement involves steps to provide meaningful access to individuals with Low English Proficiency (LEP). The American Dental Association (along with other agencies) have expressed their disagreement over the unreasonable implementation timeline and burden this imposes on small dental businesses. The OCR declined the request.
Compliance with Section 1557 means practices must post notices of nondiscrimination as well as taglines in the top 15 non-English languages spoken in the state indicating that free language assistance services are available. These notices must be posted in the office, on the website and in significant publications and communications. Further, the OCR website recommends training for your entire staff: “The U.S. Department of Health & Human Services Office for Civil Rights (HHS OCR) strongly encourages entities to train their employees on compliance with Section 1557.”
